By accessing or using the website located at masonrysantafe.com (the "Site") or by engaging Custom Santa Fe Concrete & Masonry ("we," "us," or "our") for any masonry or concrete services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use this Site or engage our services.
We reserve the right to update these Terms at any time. The effective date at the top of this page will reflect the most recent revision. Your continued use of the Site or our services after any change constitutes acceptance of the revised Terms.
Custom Santa Fe Concrete & Masonry is a masonry and concrete contractor serving Santa Fe, NM and surrounding communities. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related masonry and concrete work.
All services are subject to a written estimate and a separate service agreement executed between you and Custom Santa Fe Concrete & Masonry prior to the commencement of work. Nothing on this website constitutes an offer to perform services at a specific price.
Estimates provided by Custom Santa Fe Concrete & Masonry are based on information available at the time of the on-site visit. Estimates are not binding quotes unless confirmed in a written proposal signed by both parties. Actual costs may vary if unforeseen conditions are discovered once work begins (for example, hidden structural damage, soil conditions, or pre-existing defects not visible during the estimate). We will notify you of any material change in scope or cost before proceeding with additional work.
All prices are quoted in U.S. dollars and are subject to applicable state and local taxes.
Project start dates are confirmed in writing after a signed proposal and any required deposit are received. We make every reasonable effort to honor scheduled dates. We reserve the right to reschedule due to weather, permit delays, or other circumstances beyond our control, and we will notify you as soon as possible.
If you need to cancel or reschedule a confirmed project, please notify us by phone or email as early as possible. Cancellation policies, including any non-refundable deposit terms, will be specified in your written service agreement. In general, any materials already ordered or fabricated specifically for your project may be non-refundable.
Payment terms are outlined in your written service agreement. Most projects require a deposit prior to scheduling or material procurement, with the remaining balance due upon substantial completion of the work. We accept payment methods as specified in your agreement. Invoices not paid by their due date may be subject to a late fee. Any dispute regarding an invoice must be communicated to us in writing within 10 days of receipt.
We reserve the right to stop work on any project with an outstanding past-due balance. Resumption of work will be scheduled after payment is received and cleared.
Any warranty on workmanship provided by Custom Santa Fe Concrete & Masonry will be described specifically in your written service agreement. Unless otherwise stated in writing, our workmanship warranty covers defects in installation or craftsmanship and does not cover damage caused by subsequent acts of nature, freeze-thaw cycles beyond normal seasonal expectations, improper homeowner maintenance, settlement unrelated to our work, or modifications made by others after project completion.
Material warranties, if any, are provided by the manufacturer and are separate from our workmanship warranty. We will pass through any available manufacturer warranties to you to the extent we are permitted to do so.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Custom Santa Fe Concrete & Masonry and its employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or our services - including, but not limited to, loss of revenue, loss of data, or property damage not directly caused by our negligence. Our total liability to you for any claim arising out of a service we provide will not exceed the amount you paid us for that specific project.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
